This is a legal agreement ("Agreement") between you and Full Send Funding LLC, a New York limited liability company ("Full Send Funding"), which may be contacted at 10 Ashlor Drive, Middle Grove, New York. By accessing the website and using any of the Services (as defined below) accessible though the Site, you become a user and agree to, and are bound by, the terms and conditions of this Agreement for as long as you continue to use the Site or Services.
Full Send Funding provides revenue-based business funding — including business cash advances, term funding, and lines of credit — to qualified small businesses. For specialized products and premium offerings, and only if the business chooses to after discussing its options with Full Send Funding, Full Send Funding may also arrange funding through a direct lending partner in order to secure terms suited to a business's profile. All funding is subject to underwriting review and the terms of a separate funding agreement.
This Agreement is subject to change by Full Send Funding in its sole discretion at any time, with or without notice. Your continued use of this Site or the Services after the posting of revisions to this Agreement will constitute your acceptance of such revisions.
As used in this Agreement, "Full Send Funding" includes "we", "us" and variations such as "our". "Service" includes the products, services and software that you order, receive or access as part of the service.
As a user of the Site or a user registered to use any of the Services (a "Registered User"), you agree to the following terms and conditions.
You hereby acknowledge and agree that Full Send Funding is the owner of all rights in and to the Site and Services. You are permitted to use the Site and Services only as expressly authorized by this Agreement. You may not copy, reproduce, distribute or create derivative works, reverse engineer or reverse compile any of the Site or Services.
For information about the collection and possible use of information and material provided by you, please refer to Full Send Funding's Privacy Policy located on the Site. By using the Site or the Services, you are consenting to the terms of Full Send Funding's Privacy Policy.
Applying for funding through the Site is free — Full Send Funding does not charge a fee to submit an application. Submitting an application does not guarantee an offer of funding, a particular funding amount, or particular terms. Any offer extended is subject to underwriting review and is governed by the separate funding agreement presented with that offer.
The Site and Services may contain links to websites of third-parties. Full Send Funding is not responsible for the content of any linked site. The inclusion of any link does not imply that Full Send Funding endorses or accepts any responsibility for the content on such third-party website.
Where funding is arranged through a direct lending partner, that partner may access your application information solely for the purpose of evaluating and providing business funding. The specific amount, cost, remittance schedule, and all other terms of any funding are set out in the funding agreement you sign at acceptance, which governs in the event of any conflict with this Site.
FULL SEND FUNDING PROVIDES THE SERVICES ON AN "AS IS" AND "AS AVAILABLE" BASIS AND GRANTS NO WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY OR OTHERWISE WITH RESPECT TO THE SERVICES OR THE SITE, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR NON-INFRINGEMENT.
IN NO EVENT WILL FULL SEND FUNDING BE LIABLE FOR ANY INCIDENTAL, SPECIAL, CONSEQUENTIAL OR INDIRECT DAMAGES ARISING OUT OF OR RELATING TO THE USE OR INABILITY TO USE THE SERVICES, INCLUDING DAMAGES FOR LOSS OR CORRUPTION OF DATA OR PROGRAMS, SERVICE INTERRUPTIONS AND PROCUREMENT OF SUBSTITUTE SERVICES.
You agree to indemnify, defend and hold harmless Full Send Funding, its officers, directors, employees, agents and third parties, for any losses, costs, liabilities and expenses relating to or arising out of your use of or inability to use the Site or Services.
We may use your email address to send you messages notifying you of important changes to the Services or special offers. We may also contact you by telephone if you voluntarily provide us with your telephone number.
Every phone call with Full Send Funding is recorded for quality, training and our records.
This agreement will become effective upon your acceptance and will remain in effect unless terminated. Either you or Full Send Funding may terminate your account at any time, for any reason, without explanation, effective upon written notice to the other party.
You may withdraw a pending application or ask us to close your profile at any time by contacting Customer Service at 518-312-0382.
You agree that New York law will govern this Agreement, the Site and the Services and that any dispute will be subject to the exclusive jurisdiction of the federal and state courts in New York.
